1. About These Terms

These terms and conditions ("Terms") govern your use of EndorsementWall.com ("the Platform"), operated by Industrial Strategic Ltd, registered in Scotland (SC685479), with its registered office at 5 South Charlotte Street, Edinburgh, EH2 4AN.

By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Definitions

  • "Campaign Manager" — a registered user who creates and manages an endorsement wall
  • "Endorser" — any person who submits an endorsement through the Platform
  • "Endorsement" — text, photo, video, or audio content submitted through the Platform
  • "Organisation" — a campaign, charity, business, or other entity using the Platform

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to create an account
  • One person or entity may hold multiple accounts for different campaigns
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription Plans & Payment

4.1 Plans

  • Standard (£30/month): Endorsement wall with EndorsementWall.com branding, email verification, AI moderation, QR codes, CSV export, thank-you emails
  • Premium (£40/month): All Standard features, plus custom domain support, no EndorsementWall.com branding, bulk email to endorsers

4.2 Payment Terms

  • All prices are exclusive of VAT where applicable
  • USD pricing is calculated from GBP at the prevailing exchange rate, rounded to the nearest dollar
  • Subscriptions are billed monthly in advance
  • You may cancel at any time; access continues until the end of the billing period
  • We do not offer refunds for partial months

5. Endorsement Content

5.1 Endorser Responsibilities

By submitting an endorsement, you:

  • Confirm the endorsement is your own genuine opinion
  • Grant the Campaign Manager a non-exclusive, worldwide licence to display your endorsement
  • Consent to your name, location, and endorsement being displayed publicly
  • Agree that your endorsement may be moderated by AI and/or human review

5.2 Campaign Manager Responsibilities

Campaign Managers must:

  • Review and moderate endorsements in good faith
  • Not fabricate, edit, or materially alter endorsement content
  • Comply with all applicable election laws and regulations, including electoral imprint requirements
  • Handle endorser personal data in accordance with applicable data protection laws
  • Remove endorsements promptly if requested by the endorser

6. Prohibited Content

You must not submit or publish content that:

  • Is defamatory, threatening, or constitutes hate speech
  • Infringes intellectual property rights
  • Contains malware, spam, or misleading information
  • Violates any applicable law or regulation
  • Impersonates another person

We reserve the right to remove any content that violates these Terms without notice.

7. Data Ownership & Export

  • Campaign Managers retain ownership of their campaign data and endorsement content
  • You may export your data (endorsements, endorser details) as CSV at any time
  • Upon account deletion, we will retain data for 12 months for legal compliance, then permanently delete it
  • We will not use your campaign data for purposes other than providing the Platform service

8. Custom Domains

Premium plan customers may connect a custom domain or subdomain. You are responsible for:

  • Owning or having authority to use the domain
  • Configuring DNS records as instructed
  • Ensuring the domain does not infringe any trademarks

9. Intellectual Property

The Platform, including its design, code, brand, and documentation, is owned by Industrial Strategic Ltd. You may not copy, modify, or reverse-engineer any part of the Platform.

The "EndorsementWall" name and logo are trademarks of Industrial Strategic Ltd.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
  • We are not responsible for the content of endorsements or how Campaign Managers use endorser data

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

11. Indemnification

You agree to indemnify and hold harmless Industrial Strategic Ltd from any claims, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.

12. Termination

  • You may close your account at any time from your dashboard
  • We may suspend or terminate access for breach of these Terms
  • Upon termination, your right to use the Platform ceases immediately
  • Sections relating to liability, intellectual property, and governing law survive termination

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Continued use after changes take effect constitutes acceptance.
